1. Agreement to Terms

Welcome to Carvetka. These Terms of Service ("Terms") constitute a legally binding agreement between you and DEFIANT LLC ("Carvetka," "we," "us," or "our") regarding your access to and use of the Carvetka website at carvetka.com, mobile applications, and related services (collectively, the "Service").

Please read these Terms carefully before using Carvetka.

2. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on our website with a new "Last Updated" date
• Sending an email notification to your registered email address
• Displaying a prominent notice within the Service

Your continued use of the Service after changes take effect constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service and may delete your account.

We encourage you to review these Terms periodically to stay informed of any updates.

3. Eligibility and Account Registration

3.1 Age Requirement

You must be at least 16 years old to use Carvetka. If you are under 18, you represent that you have permission from a parent or legal guardian to use the Service.

3.2 Account Creation

To access certain features, you must create an account by providing:

• A valid email address
• A secure password
• Any other required information

You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access or security breach
• Accept responsibility for all activities under your account

3.3 Account Responsibility

You are solely responsible for:

• All activity that occurs under your account
• Maintaining the confidentiality of your login credentials
• Any content uploaded or actions taken through your account
• Ensuring your account complies with these Terms

You may not:

• Share your account credentials with others
• Create multiple accounts to circumvent restrictions
• Use another person's account without permission
• Create an account using false or misleading information

4. Subscription Plans and Billing

4.1 Service Plans

Carvetka offers three subscription tiers:

Free Plan:

• Basic vehicle tracking features
• Limited to 2 vehicles and 50 service records
• No payment required

Premium Plan ("Pro"):

• $8.99/month or $89/year (billed annually)
• Unlimited vehicles, records, and premium features
• 14-day free trial for new Premium subscribers

Family Plan:

• $12.99/month or $129/year (billed annually)
• All Premium features plus family sharing for up to 4 members
• 14-day free trial for new Family subscribers

4.2 Billing and Payment

Payment Authorization:

• By subscribing to a paid plan, you authorize us to charge your payment method
• Subscriptions automatically renew unless cancelled before the renewal date
• You agree to pay all applicable fees and taxes

Payment Processing:

• Payments are processed securely through Stripe, our third-party payment processor
• You must provide valid payment information
• We do not store complete credit card numbers

4.3 Free Trial

Trial Terms:

• New Premium and Family subscribers receive a 14-day free trial
• You must provide valid payment information to start a trial
• You will be charged automatically when the trial ends unless you cancel
• Only one free trial per user
• We reserve the right to determine trial eligibility

4.4 Cancellation and Refunds

How to Cancel:

• Cancel anytime through your account settings
• Cancellation takes effect at the end of your current billing period
• You retain access to paid features until the period ends
• No partial refunds for unused time in the billing period

Refund Policy:

• 30-Day Money-Back Guarantee: New subscribers can request a full refund within 30 days of their first payment
• Refund requests after 30 days are evaluated on a case-by-case basis
• Annual subscriptions: Refunds calculated on a pro-rata basis after 30 days (at our discretion)
• No refunds for violations of these Terms

5. Acceptable Use

5.1 Permitted Use

You may use Carvetka to:

• Track and manage your personal vehicle maintenance
• Store service records, documents, and photos
• Organize vehicle-related expenses
• Share vehicle information with authorized family members (Family Plan)
• Generate maintenance reports

5.2 Prohibited Activities

You agree NOT to:

• Use the Service for any illegal purpose or in violation of any laws
• Upload content that violates intellectual property rights
• Store or transmit malicious code or viruses
• Attempt to gain unauthorized access to any part of the Service
• Reverse engineer, decompile, or disassemble any aspect of the Service
• Use automated systems (bots, scrapers) without permission
• Resell or redistribute the Service without authorization
• Interfere with other users' access or enjoyment

6. User Content

6.1 Your Content

"User Content" means any information, data, text, photos, documents, or other materials you upload, submit, or store through the Service, including vehicle information, maintenance records, photos, documents, notes, and expense data.

By uploading User Content, you grant Carvetka a worldwide, non-exclusive, royalty-free license to:

• Store, process, and display your content as necessary to provide the Service
• Create backups and copies for technical operations
• Analyze content to improve features (in aggregate, anonymized form only)

7. Intellectual Property Rights

7.1 Carvetka's Intellectual Property

The Service and its entire contents, features, and functionality are owned by DEFIANT LLC and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

7.2 Trademarks

"Carvetka" and our logo are trademarks of DEFIANT LLC. You may not use our trademarks without our prior written permission.

8. Disclaimers and Limitations of Liability

8.1 Service "As Is"

Carvetka is a record-keeping tool, not a professional service. We do not provide mechanical, automotive, warranty, legal, or financial advice. Always consult qualified professionals for vehicle maintenance and repair decisions.

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEFIANT LLC SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, or consequential damages
• Loss of profits, revenue, data, or business opportunities
• Our total liability shall not exceed the greater of $100 USD or the amount you paid us in the 12 months before the claim arose

9. Termination

9.1 Termination by You

You may terminate your account at any time through your account settings or by contacting support@carvetka.com.

9.2 Termination by Us

We may suspend or terminate your account immediately, without notice, if you violate these Terms, use the Service for fraudulent or illegal activities, or if we are required to do so by law.

10. Dispute Resolution

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Belarus, without regard to its conflict of law provisions.

10.2 Jurisdiction

Any legal action or proceeding arising out of or related to these Terms or the Service shall be brought exclusively in the courts located in Belarus. You consent to the personal jurisdiction of such courts.
